Know your contracts, Be a agent not a paper pusher.

I sell REO properties here in the Phoenix Metro area, We Last evening I eceived a Cure notice from a agent, informing me that the seller is in breach, i looked at the notice it was because the seller did not respond to his Buyer inspection notice which he submitted on 1/19/2010.

Well, Here in AZ you have a 10 day inspection period to inspect the home, This concludes with the submission of a request for repairs.

Once the request is submitted the seller has 5 days to respond, they can either say yes we will fix everything, no we wont fix anything or here is what we will fix.

Buyer has 3 days to respond.

Now here is teh thing, No response is a response, the response is we are not doing anything, this agent is attempting to confuse the situation because her missed his time lines, he didn't read the contract and misrepresented his client.

This agent was operating outside his area of expertise and cost his client.

the client will never know anything but that they lost their earnest money buying a REO form a big bad uncaring bank, nothing about the fact that he missed his dates.

Oh his best answer when i was attempting to talk to him was that "I'm a broker",

I'm a citizen of this great country but that doesn't make me a good candidate for President.

A New Orleans lawyer sought an FHA loan for a client.

He was told the loan would be granted if he could prove satisfactory title to a parcel of property being offered as collateral. The title to the property dated back to 1803, which took the Lawyer three months to track down. After sending the information to the FHA, he received the following reply:

"Upon review of your letter adjoining your client's loan application, we note that the request is supported by an Abstract of Title. While we compliment the able manner in which you have prepared and presented the application, we must point out that you have only cleared title to the proposed collateral property back to 1803. Before final approval can be accorded, it will be necessary to clear the title back to its origin."

Annoyed, the lawyer responded as follows:

"Your letter regarding title in Case No. 189156 has been received. I note that you wish to have title extended further than the 194 years covered by the present application. I was unaware that any educated person in this country, particularly those working in the property area, would not know that Louisiana was purchased, by the U.S., from France in 1803, the year of origin identified in our application. For the edification of uninformed FHA bureaucrats, the title to the land prior to U.S. ownership was obtained from France, which had acquired it by Right of Conquest from Spain. The land came into the possession of Spain by Right of Discovery made in the year 1492 by a sea captain named Christopher Columbus, who had been granted the privilege of seeking a new route to India by the Spanish monarch, Isabella. The good queen, Isabella, being a pious woman and almost as careful about titles as the FHA, took the precaution of securing the blessing of the Pope before she sold her jewels to finance Columbus' expedition. Now the Pope, as I'm sure you may know, is the emissary of Jesus Christ, the Son of God, and God,it is commonly accepted, created this world. Therefore, I believe it is safe to presume that God also made that part of the world called Louisiana.

God, therefore, would be the owner of origin and His origins date back, to before the beginning of time, the world as we know it AND the FHA. I hope you find God's original claim to be satisfactory. Now, may we have our loan?"

The loan was approved.

How crazy is this, Thief has rights, I don't..........

Last week my wallet and some other items was stolen, Visa went to work and notified me about some suspicious activity on my account but some charges went through for Internet purchases.

I reported the theft and activity to the police and then i called my bank that the charge was on, I wanted to find out who the item was shipped to so i could pass that information to the police.

Imagine my surprise when i was told by the bank that they would not release this information to me due to privacy concerns for the THIEF.

I was so shocked that i could not

 respond, The theif has rights and I, the person who was stolen from has none.

Funny where this world has gone to.

A Week at the Gym, Sent to me by a friend ~ Humor

A WOMAN'S WEEK AT THE GYM
This is dedicated to everyone who ever attempted to get into a regular workout routine. 

Dear Diary,
For my birthday this year, my Husband (the dear) purchased a week of personal training at the local health club for me.

Although I am still in great shape since being a high school football cheerleader 43 years ago, I decided it would be a good idea to go ahead and give it a try. 

I called the club and made my reservations with a personal trainer named Christo, who identified himself as a 26-year-old aerobics instructor and model for athletic clothing and swim wear.

My husband seemed pleased with my enthusiasm to get started! The club encouraged me to keep a diary to chart my progress. 

MONDAY:
Started my day at 6:00 a.m. Tough to get out of bed, but found it was well worth it when I arrived at the health club to find Christo waiting for me. He is something of a Greek god - with blond hair, dancing eyes and a dazzling white smile. Woo Hoo!! 

Christo gave me a tour and showed me the machines. I enjoyed watching the skillful way in which he conducted his aerobics class after my workout today. Very inspiring!

Christo was encouraging as I did my sit-ups, although my gut was already aching fromholding it in the whole time he was around. This is going to be a FANTASTIC week-!!

TUESDAY:
I drank a whole pot of coffee, but I finally made it out the door. Christo made me lie on my back and push a heavy iron bar into the air then he put weights on it! My legs were a little wobbly on the treadmill, but I made the full mile. His rewarding smile made it all worthwhile. I feel GREAT-!! It's a whole new life for me.

WEDNESDAY:
The only way I can brush my teeth is by laying the toothbrush on the counter and moving my mouth back and forth over it. I believe I have a hernia in both pectorals. Driving was OK as long as I didn't try to steer or stop. I parked on top of a GEO in the club parking lot. 

Christo was impatient with me, insisting that my screams bothered other club members. His voice is a little too perky for that early in the morning and when he scolds, he gets this nasally whine that is VERY annoying. 

My chest hurt when I got on the treadmill, so Christo put me on the stair monster. Why the hell would anyone invent a machine to simulate an activity rendered obsolete by elevators? Christo told me it would help me get in shape and enjoy life. He said some other shit too.

THURSDAY:
Asshole was waiting for me with his vampire-like teeth exposed as his thin, cruel lips were pulled back in a full snarl. I couldn't help being a half an hour late - it took me that long to tie my shoes. 

He took me to work out with dumbbells. When he was not looking, I ran and hid in the restroom. He sent some skinny bitch to find me.

Then, as punishment, he put me on the rowing machine -- which I sank.

FRIDAY:
I hate that bastard Christo more than any human being has ever hated any other human being in the history of the world. Stupid, skinny, anemic, anorexic little aerobic instructor. If there was a part of my body I could move without unbearable pain, I would beat him with it. 

Christo wanted me to work on my triceps. I don't have any triceps! And if you don't want dents in the floor, don't hand me the damn barbells or anything that weighs more than a sandwich.

The treadmill flung me off and I landed on a health and nutrition teacher. Why couldn't it have been someone softer, like the drama coach or the choir director?

SATURDAY:
Satan left a message on my answering machine in his grating, shrilly voice wondering why I did not show up today. Just hearing his voice made me want to smash the machine with my planner; however, I lacked the strength to even use the TV remote and ended up catching eleven straight hours of the Weather Channel.

SUNDAY:
I'm having the Church van pick me up for services today so I can go and thank GOD that this week is over. I will also pray that next year my husband will choose a gift for me that is fun -- like a root canal or a hysterectomy. I still say if God had wanted me to bend over, he would have sprinkled the floor with diamonds!!!

FHA updates/relaxes its 90 Day Flip Rule

FHA/HUD has just announced that it is relaxing its 90 Flip rule for a period of one year.  This waiver is effective for all sales contracts dated on or after February 1, 2010.  HUD is waiving the 90 day waiting period which means that homes CAN be sold within 90 days of the date of their prior sale.  Here are some of the key details:

 

1.     Applies to private sellers and investors selling their homes

2.     Arms length transactions only

3.     In cases where the sales price is 20% or greater than the seller's acquisition, we must justify the increase in value with supporting documentation of renovation, repair and rehabilitation work

a.     If no such work was performed the appraiser must provide an appropriate explanation of the increase in property value since the prior title transfer

b.     We must order a property inspection and provide that report to the home buyer

I have been looking to find a robust, all round buyer side website solution and had decided to move forward with one that due to customer service action i would not recommend to anybody i have been looking at Realpo systems and Number1 Expert but am open to listen to others, any ideas?.

HAFA posts and short sale update posts are being put forth in front of the consumers and homeowners ALL over the internet, there are short sale posts right here on Active Rain that are being Featured that are wrong, not factual and whatever else you may wish to say about them. This is not the fault of those who are featuring the posts because they don't know about short sales and don't sell short sales. It is the fault of the bloggers who take it upon themselves to write posts before checking their facts.

It is one thing to write your opinion but quite another to write a post about short sales that is only one's opinion but not disclosing that.

The reason this is so important is because you have desperate homeowners who are looking on the internet for help, for some resolve to their problems. Most of them do not have the money to hire an attorney and so they turn to the next most obvious place- real estate blogs.

Please check your facts before you post about HAFA, about short sales, about how short sales are going to work and so on and so forth. It is after all, the right thing to do. Take the high road when blogging about short sales.

When I write about short sales and as I work through helping you to understand the 43 page document and forms of the HAFA guidelines I will let you know what is fact and what is my opinion. Our opinions are based on our intense experience in closing short sales and discussing particulars with negotiators at the lenders, the lenders, the servicers, the VPs and so on at different lenders and servicers.

I know many bloggers want to get the Google juice for the HAFA guidelines and so bloggers will just write a quick post without checking the facts, they do so based on hear say from other bloggers or what their broker may have told them.
